ASA Going After SkyVegas For No Lose Promotion

UK Advertising Watchdog Upholds complaints.
Bonne Terre Ltd trading as Sky Vegas was sanctioned by the UK Advertising Standards Authority (ASA) this week after the watchdog received two complaints concerning an internet promotion for its Sky Vegas brand.
The promo, in January 2016, featured a page on which text stated “No Lose Month No Lose Month. Throughout January! Play Risk Free throughout January at Sky Vegas – Terms Apply".
Under terms and conditions, players were further instructed to “simply opt in to each No Lose offer and play the selected games for 100% Cashback on Net Losses.” The offers were subject to a cap and other terms and conditions.
Sky Vegas committed to depositing the no lose payment into customers’ accounts the day after the offer expired.
Both complainants said although they understood that there was a limit to the amount that would be credited to cover losing bets and that any money returned was subject to a minimum wagering requirement, the claims No Lose and Risk-Free were misleading.
The ASA upheld the complaint saying it considered the terms and conditions contradicted the claim "100% Cashback on Net Losses".
Sky Vegas was instructed to ensure that future qualifications clarified, rather than contradicted, their headline claims, and that offers were not advertised as carrying no risk if a risk-based wagering requirement applied to returned funds and where returned funds were not withdrawable as cash.
